What Is An Uncontested Divorce?

What is a no fault divorce?

Michigan has enacted a no fault divorce law. No fault divorce is what is meant by “irreconcilable differences” or “irretrievable breakdown of the marriage.” In general, the only grounds required for one spouse to file for a no-fault divorce is appearing in court and, under oath, declaring that the marriage is irretrievably broken; both spouses can mutually agree to the same. In order to obtain a divorce in Michigan it is not necessary to establish that one or both parties were at fault in the marriage. All that is necessary is that there be a showing that there has been a breakdown in the marriage relationship to the extent that the objects of matrimony have been destroyed and there remains no reasonable likelihood that the marriage can be preserved. 

Please note, multiple grounds may be alleged because marital "fault" is permitted to be taken into account in the court's division of property and alimony.  Proof of "fault" may be considered even in "no fault" divorces.

An uncontested divorce occurs when: (a) there are no disputes or disagreements between you and your spouse over any financial or divorce-related issues (i.e., child custody and support, division of marital property or spousal support); and (b) your spouse either agrees to the divorce or fails to to file a formal response with divorce court.

You must be a resident of Michigan for at least 6 months
There is a 6 month waiting period before divorce with children is final.
There is a 2 month waiting period before divorce without  children is final.
What Happens During a Divorce?

The process of divorce in the state of Michigan is as follows.

It begins with a spouse filing for a divorce and then the complaint for divorce must be served to the other spouse.

A response to the compliant must be filed by the other spouse within 21 days or 28 days depends on the nature of the service.

Then the two parties must share information this is what is called a discovery.

Then there is called an Order to show cause, this is when the parties need the court to interject in cases of child custody for example.

After discovery a spouse will proceed with the trial and a Mandatory Settlement Conference will be called before trial. This is an attempt to settle issues before the case is taken to court. The case is then brought to trial where the attorneys present their evidence. The judge then resolves all other outstanding issues and then signs the divorce judgment.
