What Is An Uncontested Divorce?

What is a no fault divorce in Wayne County?

Michigan has enacted a no fault divorce law. No fault divorce is what is meant by “irreconcilable differences” or “irretrievable breakdown of the marriage.” In general, the only grounds required for one spouse to file for a no-fault divorce is appearing in court and, under oath, declaring that the marriage is irretrievably broken; both spouses can mutually agree to the same. In order to obtain a divorce in Michigan it is not necessary to establish that one or both parties were at fault in the marriage. All that is necessary is that there be a showing that there has been a breakdown in the marriage relationship to the extent that the objects of matrimony have been destroyed and there remains no reasonable likelihood that the marriage can be preserved.  

Please note, multiple grounds may be alleged because marital "fault" is permitted to be taken into account in the court's division of property and alimony.  Proof of "fault" may be considered even in "no fault" divorces.
